Inhumane Conditions or Care

People in custodial care may be vulnerable to abuse because of a lack of appropriate oversight over their confinement. Inhumane conditions of confinement or callous disregard for serious safety, medical, or mental health needs while confined can lead to serious injuries and/or death.

Estate of Darian Mack v. Johnson County Sheriff and Dr. Mader Darian Mack was an inmate at the Johnson County Jail who suffered delirium tremens from alcohol withdrawal and internal bleeding caused by blunt force trauma during a fall in his jail cell. Mr. Mack, a 37-year-old father, was not given prompt and adequate treatment and died from his injuries. The lawsuit concluded by way of settlement in 2014.

Estate of Perry v. Boone County Sheriff Wrongful death case brought by family of a father of three young children contending deliberate indifference to urgent medical needs. This man was left in a padded cell for 5 days without adequate medical care while undergoing alcohol withdrawal and died in the jail. Settlement for our client achieved in 2009 and 2010.

Grande v. Marion County Sheriff Federal lawsuit brought on behalf of woman involved in car accident, in which she suffered a severely injured broken arm. While en route to the hospital, she was arrested for an outstanding bench warrant. The Arrestee Processing Center staff took her fingerprints despite her broken arm, causing extensive additional nerve damage. Jury award for client in August 2009.

Estate of Hupp v. Howard County Sheriff Wrongful death lawsuit brought by family of 29 year-old man with a history of severe alcohol withdrawal symptoms, who died of delirium tremors in the jail three days after his arrest, without receiving appropriate medical care despite assurances to the plaintiff’s father that he would. Settlement achieved for client in 2002.

Estate of Bales v. Hancock County Sheriff Wrongful death lawsuit brought on behalf of man who died in jail from treatable but urgent medical condition when jail staff failed to medically screen or adequately monitor him, or seek life-saving medical care. Settlement for client achieved in 2010.

Estate of Fidler v. Greene County Sheriff et al. Wrongful death lawsuit brought by parents of 18 year-old boy who was deprived of life-saving medical care to reverse the effect of a drug overdose. At the time of arrest, plaintiff was severely impaired and at times unconscious. Yet he was processed into the jail anyway, and died within hours of his arrival. Settlement for our client achieved in 2009.
